Terms of Service & User Registration Agreement

This Terms of Service and User Registration Agreement ("Agreement") is a legally binding agreement between you ("you" or "User") and ARISE CHARM TECHNOLOGY CO. LTD. ("Arise Charm", "we", "us", or "our"), the operator of the Arise Games cloud gaming platform (the "Service"). By registering an account, creating a user profile, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to register for and use the Service. By registering you represent and warrant that you meet this requirement and that all information you provide is true, accurate, and complete. If you are registering on behalf of a company or organisation, you represent that you have authority to bind that entity to this Agreement.

2. Account Registration and Security

• You must provide a valid email address and a username that complies with our naming policy. Each account is personal and non-transferable.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must notify Arise Charm immediately of any unauthorised use of your account. Arise Charm is not liable for losses arising from your failure to safeguard your credentials.
• We reserve the right to suspend or terminate accounts that are created through automated means, that impersonate others, or that violate this Agreement.

3. Subscriptions and Billing

• The Service is offered on a monthly subscription basis. Current plans, features, and prices are displayed on the subscription page and form part of this Agreement.
• All prices are inclusive of applicable taxes unless stated otherwise. Payments are processed through the payment methods we support; you agree to pay all charges associated with your account.
• Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
• You may cancel your subscription at any time; access continues until the end of the current billing period. Refunds are governed by our Refund Policy.
• We may change plan features or pricing at any time. Price changes will be communicated in advance and will take effect at the start of your next billing period.

4. Acceptable Use

You agree not to use the Service to:

• violate any applicable law or regulation;
• infringe the intellectual property, privacy, or other rights of any third party;
• attempt to access, tamper with, or circumvent the security, servers, or infrastructure of the Service;
• resell, redistribute, or sublicense access to the Service without our prior written consent;
• reverse engineer, decompile, or attempt to derive the source code of any software provided through the Service;
• use automated tools to create accounts, farm in-game rewards, or otherwise interfere with fair use of the Service.

5. Intellectual Property

The Arise Games name, branding, website design, and software are owned by ARISE CHARM TECHNOLOGY CO. LTD. Game titles, artwork, and trademarks belong to their respective owners and are made available through the Service under licences held by Arise Charm. Nothing in this Agreement grants you any ownership interest in the Service or its content. You may not reproduce, distribute, or publicly display any part of the Service except as expressly permitted in writing.

6. Limitation of Liability

To the maximum extent permitted by law, ARISE CHARM TECHNOLOGY CO. LTD. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability arising from or related to this Agreement shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

7. Suspension and Termination

We may suspend or terminate your account and access to the Service, in whole or in part, at our sole discretion, with or without notice, where we reasonably believe you have breached this Agreement, where required by law, or where we decide to discontinue the Service. On termination your right to use the Service ceases immediately. Provisions of this Agreement that by their nature should survive termination shall survive it.

8. Changes to this Agreement

We may update this Agreement from time to time. The latest version will always be published on this page with the effective date shown above. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement. If you do not agree to the changes, you must stop using the Service and cancel your subscription.

9. Governing Law and Disputes

This Agreement is governed by the laws of the Republic of India. Any dispute arising out of or in connection with this Agreement shall first be referred to good-faith negotiation between the parties. If the dispute cannot be resolved within thirty (30) days, it shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in India. Nothing in this clause prevents either party from seeking injunctive or equitable relief.
